Judicial control of administrative acts in light of the theory of institutional capabilities

This article intends to address the practical use of the theory of institutional capabilities in the judicial control of administrative acts, pointing out its relevance in maintaining balance and separation between the Powers of the Republic, differentiating the types of administrative act - in terms of freedom of action of the public administrator – as a starting point to limit the exercise of this control and finally tracing a history of the development of the theory in the jurisprudence of the Federal Supreme Court, highlighting the main points that involve its guidance and then, using the decision-making elements exposed, prepare an overview of the hypotheses for applying the theory as a limit to judicial control of administrative acts.References
