Abstract

From the survey of cases judged by the Superior Court of Justice, over a period of 20 (twenty) years, the study proposes the basic value for purposes of moral reparation in cases of undue inclusion in a defaulter's list. Based on the procedural data regarding the updated values of the convictions, it was possible to elaborate three scenarios, with the quantification of the annual average of payments, which confirmed the tendency for a decrease in the value of moral reparation, indicating what can be expected in new lawsuits. The study raises some hypotheses to be tested as to the causes of the downward trend in payments.

Especialista em Teoria do Direito e Filosofia do Direito pela Universidade de Lisboa (2014). Graduado em Direito pela Universidade Federal do Rio de Janeiro (2000). Atualmente é juiz de direito no Tribunal de Justiça do Estado do Rio de Janeiro, investigador em Teoria e História do Direito do Centro de Investigação da ULisboa registrado na Fundação para a Ciência e a Tecnologia de Portugal e professor de Teoria do Direito, Filosofia do Direito e Ética da Escola da Magistratura do Estado do Rio de Janeiro - EMERJ.
