The text seeks to work on the need for the Judiciary to base its decisions on the reality of the intense suffering of trans people who seek Justice to obtain the requalification of name and gender. Overcoming bureaucratic-theoretical issues, concrete cases and a protocol for the interposition of actions, which can assist the judges in understanding the right to difference that integrates the fundamental of the human personality, so as to enable, at some point in the near future, that those issues reach the Supreme Court in Brazil.
