The article analyzes procedural aspects of the Banco Master case at the STF, investigating the grounds for retaining the case in the Court after the investigated individual ceased exercising the public office that justified the specialized forum. It examines the Order in Criminal Action 933 and the "elastic connection" theory, evaluating its effects on the Natural Judge Principle and the potential for jurisdictional uncertainty. It scrutinizes the Federal Police's standing to request a Justice's recusal, contrasting Article 95 of the CPP with the "reflexive extraordinary standing" thesis based on investigative oversight and the Court Presidency's powers. The expansion of the investigative scope (CVM and Reag manager) is discussed as a factor in maintaining original jurisdiction due to evidentiary complexity. The theoretical framework, grounded in Luigi Ferrajoli's guarantism and Carl Schmitt's decisionism, informs the debate on the tension between prosecutorial efficiency and strict procedural compliance. It concludes that the case highlights challenges to maintaining constitutional boundaries on jurisdiction and the balance of powers.
