Foundations for an interdisciplinary approach to child and adolescent rights

Although the Convention on the Rights of the Child, the Federal Constitution and the Statute of Children and Adolescents have been in force for more than thirty years, there is still difficulty in implementing the doctrine of full protection in view of the institutional embarrassment of abandoning paternalistic practices or assistance aimed at children and youth. Children’s and Adolescents’ Law has its genesis in international human rights, which attracts its methodology and foundations, highlighting the need for an interdisciplinary approach. In the Convention and in national legislation, it is possible to detect an ambiguity or tension between rights related to protection and rights related to autonomy, which can be solved by interdisciplinarity with other social and human sciences in order to open the horizon of legal science in searching for interpretation and solution for specific cases involving children and adolescents. The method applied is deductive, with qualitative, theoretical and bibliographic research in which, initially, the rights of children and adolescents were linked to human rights, and then focused on the need for interdisciplinarity to understand childhood and adolescence and parental and state power in the enforcement of these rights.
