Amicus curiae in civil proceedings

Before the entry into force of the 2015 Code of Civil Procedure, the amicus curiae was disciplined in a sparse and punctual manner in the legislation, including, among others, Law No. 9,868/1999, which provides for the Direct Action of Unconstitutionality and the Law No. 9,882/1999, which provides for the Allegation of Non-compliance with Fundamental Precepts1.
The CPC was right to strengthen and expand the presence of this agent in our legal system, as can be seen from reading article 138, enriching the debate from new perspectives of those who can effectively contribute to the excellence, completeness and precision of the final provision2.
When deciding, the judge has the duty to examine and evaluate the existing evidence in the case, face all the central arguments of the controversy, appropriately interpreting and applying legal norms, in addition to observing the reasonable duration of the process. The substantial contradiction allows the subjects of the process, through this cooperative dialogue, the right to influence the formation of the judge's conviction, giving him the conditions to make a more complete and well-founded decision.
In this context, the participation of the amicus curiae proves to be fundamental to encourage the procedural debate and, therefore, give rise to more complete and well-founded judicial pronouncements.
