ATOS ADMINISTRATIVOS DISCRICIONÁRIOS E A LAMENTÁVEL REALIDADE FRENTE AO CORONAVÍRUS

This study seeks to carry out the necessary reflection on the limits for the correct exercise of discretionary administrative power, which is an attribute of all authority when exercising administrative function. In the current moment of crisis, when purchases without bidding, reversal of orders and use of simplified procedures, unfortunately, unlawful and illegitimate acts are brought to light, and they are unforgivable from the point of view of ethics and morals. In this sense, our contribution consists of conducting a prospective analysis on how the best performance of the Administration should be in specific cases, as well as on the review of administrative acts by the Judiciary. A recent legislative change modified the Law of Introduction to the Norms of Brazilian Law (Decree-Law No. 4,657/1942), making both the analysis of specific cases and the corresponding reasoning when carrying out the administrative act mandatory, giving more emphasis to this article and to what is expected from the regular exercise of discretionary power.
