The presentation of this work aims to bring a reflection on other ways to the matter of incarceration, through the paradigm shift. The experience of Restorative Justice in several countries points to a new thought about the need for imprisonment, but also for a more effective approach the prison release. One of the aims of these brief considerations is also to arouse curiosity on the subject and instigate the reasoning for the investigation of the philosophical inspiration for the assumption of this new way by the legal practitioner.
