Indigenous electoral law in Brazil
from tutelage to intercultural citizenship

This article examines the transition from the tutelary and integrationist model of the Indigenous Statute (Law No. 6,001/1973) to the intercultural citizenship affirmed by the 1988 Brazilian Constitution (Art. 231), which recognizes full political rights for indigenous peoples without requiring cultural assimilation. The text critiques the persistence of integrationist remnants in electoral justice regulations and highlights advancements such as Superior Electoral Court Resolution No. 23,274/2010 and precedents that waive literacy requirements and fines for late voter registration. The article advocates for an intercultural Electoral Justice system characterized by prior consultation, respect for indigenous languages and customs, and coordinated actions to fully realize indigenous citizenship.
