Abstract

The conflict does not have a single concept and involves emotional issues alongside with the legal issues. A new understanding of the conflicts that reaches the Judiciary, points out that new methods of composition are needed. Alternative means of conflict resolution (negotiation, conciliation, mediation and arbitration) are instruments of great efficiency and social pacification. Mediation, as a dialogical form of conflict resolution, is a process of reconstruction of dialogues and of the art of listening between litigants through a third party who acts only as a facilitator of the rapprochement of the parties. The CNJ and the Processual Code of 2015, incorporate, in a mandatory manner, the practice of mediation, along with conciliation, in the search for solutions that might enable the reconstruction of relations despite conflicts. In the Judiciary, in order that this instrument of pacification achieves the desired effect, it is necessary to overcome the aesthetics of form, and to rethink the traditional way of thinking, under penalty of ineffectiveness of the new model.
