Abstract

The article on screen intends to reflect on the Declaratory Action of Constitutionality n. 48 in the face of Law No. 11,442 of 2007, which assigned a commercial nature to relations between a transport company and an autonomous cargo carrier. Using outsourcing as a background for the entire theoretical discussion, which can be understood with the study of what some authors understand as post-Fordism or Toyotism. Thus, through normative analysis and jurisprudence, it was concluded that and the consequent outsourcing of the core activity in the autonomous transport of cargo and all these changes made possible an apparent setback in the achievements of a Labor Law of bias and of protective interest.
