The (dis)respect for the right to vote of pre-trial detainees in the 2022 elections

The article aims to analyze the prerogative of pre-trial detainees to exercise the constitutional right to vote. The Superior Electoral Court has decided favorably on this issue when drafting and editing the Electoral Resolutions, and it was no different in 2022, however, some conditions and rules not so clear to the Brazilian population make it extremely difficult for this right to be exercised in practice.
Added to this, there is the resistance of the population to recognize that the prisoner is a subject of law, even if in the provisional modality, since many already consider him as a former citizen, even without his trial having taken place or the sentence having become final, which in Brazil is determined as an element of presumption of innocence. Thus, we will see the difficulties and consequences for the real implementation of the vote of provisional prisoners in Brazil.
