Based on an Opinion delivered by Judge Kenarik Boujikian at the Court of Justice of São Paulo in 2018, follows the conclusion that the prohibition of testimonial evidence produced by legal professional privilege holders provided in article 207 of the Brazilian Criminal Procedure Code is rooted on the Constitutional right to silence granted to the investigated and accused.
