The proliferation of cases of reclaimable damages challenges the doctrine of law to provide safe criteria for its identification. The theory of “consumer’s deviation from productive activities is an effort to codify the damages linked to the waste of the consumer’s productive time. Courts and scholars must handle carefully these types of situations, in order to avoid that the productive deviation falls into generic cases of simple unpleasantness.
