THE VIRTUAL JURY PROPOSAL AND THE NEED TO GUARANTEE THE RIGHTS OF THE DEFENDANTS

Abstract

With the emergence of COVID-19, it became necessary, to reduce the risk of contagion of the disease among the agents of the justice system and those in jurisdiction in general, to promote the suspension of face-to-face judicial acts, among which, Plenary Trial Sessions by the Jury. With the uncertainty as to the solution of the very serious health crisis, the National Council of Justice started to discuss a draft Resolution that aims to authorize the Courts of Justice and the Federal Regional Courts to hold remote juries with the help of information technology. While a magistrate entity favorably pronounced the proposal, all the other institutions that operate in the administration of justice vehemently opposed it, as, according to them, innovation would cause a series of violations of fundamental rights. In this scenario, the article is dedicated to investigating some elements that make it impossible to carry out without jeopardizing the confidentiality of trials, the legitimacy of testimonial evidence and the exercise of full defense.
