Abstract

This article examines the applicability of the principle of the search for real truth in the modern civil process, based on the determination of the legal foundations that guide its use within the current system and the power of the magistrate to guarantee the scope of the maximum degree of truth in the process to ensure, consequently, the effectiveness of judicial protection. Based on the confrontation of the dissent presented in brazilian doctrine and jurisprudence, it seeks to identify the main counterpoint and controversial issues on the matter, critically analyzing the predominant majority position in the national juridical scene and the practical implications of its adoption in the scope of the process, focused Essentially in the figure of the judge, whose intended position is intended to detect and defend.
