Brazil’s new Civil Procedural Code aims at providing more speed and effectiveness to the legal system, through mechanisms which strengthen legal certainty, equal treatment amongst parties, adversarial principle, the obligation to provide appropriate fundamentals, cooperation, objective good faith, self-determination, amongst others. In this study, we will deal with the new rules governing fees owed by losing parties.
