This study has the purpose to show the major innovations introduced by the Law No. 13.786/18, which disciplines the dissolution of Preliminary Sale and Purchase Agreement in cases where the purchase of properties happens with real estate development on the Project stage. Despite the fact that the law came in to force at the end of last year, it presents some points that are controversial to the judicial precedent of Brazilian Superior Justice Courte and has unclear topics, emerged after several shortcomings in the law. Therefore, the study also has the purpose to discuss sticking points trying not to be definitive providing solutions to the presented gaps.
